职权依据：	< p> 【部门规章】《城市公厕管理办法》（建设部令第9号）第二十四条：对于违反本办法，有下列行为之一的，城市人民政府环境卫生行政主管部门可以责令其恢复原状、赔偿损失，并处以罚款:(一)在公厕内乱丢垃圾、污物，随地吐痰，乱涂乱画的 (二)破坏公厕设施、设备的 (三)未经批准擅自占用或者改变公厕使用性质的。< br> < /p>
责任事项：	< p> 1.查处阶段责任：对在公厕内乱丢垃圾、污物、随地吐痰、乱涂乱画、破坏公厕设施设备、擅自占用或改变公厕使用性质的行为进行依法查处； < br> 2.告知并听取意见阶段责任：由两名以上行政执法人员出示执法身份证件，通知当事人到场并当场告知当事人采取行政强制措施的理由、依据以及当事人依法享有的权利、救济途径； < br> 3.作出决定阶段责任：听取当事人的陈述和申辩、制作现场笔录、现场笔录由当事人和行政执法人员签名或者盖章，当事人拒绝的，在笔录中予以注明；当事人不到场的，邀请见证人到场，由见证人和行政执法人员在现场笔录上签名或者盖章；报请县级以上市容环境卫生行政主管部门主要负责人批准作出强制执行处理决定； < br> 4.履行阶段责任：实施在公厕内乱丢垃圾、污物、随地吐痰、乱涂乱画、破坏公厕设施设备、擅自占用或改变公厕使用性质的行为依法处理； < br> 5.事后监管责任：开展后续监督管理；6.其他责任：法律法规规章文件规定应履行的责任。< br> < br> < br> < /p>
